The theory and the Sally Anne example most often used to test autistic children, is challenged by many. In the particular manner that you describe here, perhaps the error is in the use of the term empathy. So often autistic children and adults are described as lacking empathy whereas the opposite is true - generally they are far more sensitive and have greater empathy than neurotypical.
