If that is the case, I will have to notify Homeland Security, as illegal importation of ivory is a federal crime punishable by up to 10 years in jail and a $10,000 fine per chopstick.

If you are certain the chopsticks are plastic, then accept that the waitron is dumb as a sack of hammers and have a funny anecdote about it. Some folks are not only too stupid to educate, but their lack of education is going to be harmless.
