There's a table set up in the main hall of the law school this morning by members of Law Students for Reproductive Justice. They're urging everyone to sign a petition and handing out condoms encouraging people to "Celebrate Roe!" It makes me wonder what "celebrating Roe" involves. Naughty ( Read more... )

I agree that there's not much chance of the Court overturning Roe, but I do get nervous when I hear about the campaigns going on at the state level to give legal status and rights to a fetus. (At times, from the moment of fertilization. Which not only puts abortion at risk, but brings up questions about miscarriages, in vitro, stem cell, etc.)That's the new strategy of pro-lifers-approaching abortion from the back door.

I think those concerns are valid, but it's plausible that they wouldn't even make it out of the state court if challenged there. I mean, a state supreme court could hear challenges from the point that it's overreaching and could potentially punish women criminally for negligent behavior. Things like a woman drinking when she doesn't know she's pregnant but has been engaged in behavior with a high risk of pregnancy. If that behavior results in a miscarriage, then they could be charged with negligent homicide.

I think it's sneaky and underhanded and bullshit, and cause for concern, but I don't think it's ultimately going to end up the way these legislators and groups hope it will.
