Stern, claimed paternity, Smith's former boyfriend, Larry Birkhead, claimed that he was the biological father of Smith's child. A DNA test has been ordered for the child, which must take place before February 21. In the wake of Anna Nicole's death, Debra Opri, the attorney for Larry Birkhead, said her client, "is devastated.
