Insanity ensues...

Today I got a call from McCoy to inform me I was being assigned to a homicide case. Seeing as I'm the Major Case ADA and NOT the Homicide ADA I was confused. I figured I'd at least be working with Connie... not against her as opposing counsel.

Like I said - I didn't have any prior knowledge that a defense attorney wouldn't have had.

Someone has to defend him, Ms. Novak. And while I would agree to take the case if situations were different, Connie did represent him at arraignment.

As long as she promises to defend him to the best of her ability, there's nothing ethically wrong with what she's doing.

Of course someone does Counselor. All I'm saying is that I don't think it was right to choose one of the prosecuting attorneys on the case instead of one of our many available ADAs that the DA's office has at its disposal.

I'm not at odds with Connie, rather the decision that put her there in the first place. It won't change anything at this point in time, especially now that I'm sitting second chair for the prosecution but regardless I'm never going to agree with it.

I think it was more a matter of timing and convenience in this case. Tensions are running high -- or so I'm told.

To the point where I feel obligated to apologize for my profession.

It's a kind gesture but no need Mr. Toth. You're just a civil servant like the rest of us. Not a private, well-paid, defense attorney.
