now i may be mistaken here, and i hope i am, but i heard from some australians recently that, while in south africa, they read in a british newspaper that due to some patriot act related hoo-haa, the police can actually stop and demand IDs from anyone and if an ID request is refused, that someone can be arrested. now, obviously i didn't hear this from the australians, i just can't remember where i heard/read it and it's quite possible that it's all hearsay. thus, through my initial set up, i was attempting to impart upon my statement the exact gravity and reliability it deserves.

but the fact remains that the same old HOW TO TALK TO A COP websites that i read when i was fifteen probably haven't been updated in years cause they didn't need to be, but now, perhaps, there's this new shit and the website updaters are just sitting around with their thumbs in their asses talking about whether or not mike moore sold out. so maybe just check into that shit a little further or ask your Law & Government teacher or something.

If you go to www.aclu.org you can print out pamphlets/cards to carry with you or to pass out to people just so you can always have your rights with you when shit happens. They're usually up to date with everything too.. especially the patriot act stuff, so I'd bet they have everything covered.. and I think I saw some of the stuff here on the ACLU site so it wouldn't shock me if you took some of it from there.

What happened tonight that made you want to post this anyway?

I still feel like you can't successfully exercise these rights until you're 18 or so. Is that last point before the true/false thing about being stopped on the street in a car? Or is it if you're just walking down the street? The latter would be kinda conflicting with the other stuff...

But basically, from my understanding, if a cop stops you walking down the street in front of 7-11, you can just keep demanding to know why you're being stopped until they give you a good reason to produce your ID. I suppose that they weren't allowed to search Jake's bag that night at the Greenburgh playground...?

What about 'probable cause'? That and 'wreckless driving' sort of allow the cops to stop you for anything. To be realistic, I don't think that they're going to whip out the Patriot Act on basic pedestrians unless there had been some explosions or something.

Eh, probable cause. That's like when they hear screaming coming from your house while the walls are being covered with blood.. but Westchester cops don't really abide by those rules anyway as Katy learned. They might just walk in as they please.. but I'd imagine in most cases they'd let you go because it would probably be a lotta trouble breaking rules like that if they end up bringing you to court over it. Reckless driving is a whole different thing.. but neither of those means the cops can just do whatever they want.

And they basically can't ever search your bag. I've known that one for years.. unless they have a warrant.

And believe it or not you do have rights before you're 18. You are a human being and you are a citizen of the US, so why wouldn't you have rights?

Alot of that applies to me and Pete, being the designated drivers (not because people are drinking, but because you're all too lazy to get your fuckin' licenses).

Even though a cop has no right to search my vehicle, I still feel completely unsafe with booze or pot in my car. It's just me. But, with that aside, we should definetly pull this on Benedict the next time he shows up. I think the least we can do it put this shit to good use.
