There isn't a simple answer to that question because we don't know where the sex took place. If it's California (possible - she's in some kind of Nickleodeon thing) then it's 18 but with a 3-year rule i.e. it's not all that serious if the age gap is less than 3 years - she's 16 and he's 19 so as long as he's a young enough 19 then they'd be fine. If it was in Louisiana (more likely) the age is 17 with no such window of allowed law-breaking. It's also impossible to know whether the police will bother looking into a crime for which there has been no complaint from the victim or her family.
