I hate to point out that what goes for Congress goes for the rest of the United States and anything that involves what goes on IN the United States.

Actually, that's not true. The First Amendment doesn't apply to privately held companies, like Live Journal.

Live Journal isn't telling people they can't write what they want. They're telling people that certain things they write aren't allowed to be housed on the servers they own because Live Journal can be held responsible and fined for them. And they have that right, as do webhosts.

It's all kind of moot anyway. Live Journal has changed its stance on the whole thing, and legitimate journals are supposed to be restored.

In all technicality, private journal owners CAN sue as their rights are being violated. Those who have put up disclaimers and warnings, anyway. Live Journal's user terms are so broad as to what is and isn't allowed that they'd have trouble defending it. Although if it makes you uncomfortable, I'll revise it. You have a point as the way I stated what I did can be misinterpreted. Thanks for the heads up.
