Restaurant to get new name to avoid possible trademark violation

The article says they would bring a claim for trademark infringement which requires a likelihood of confusion. How many of you would think there was a connection between the restaurant and the soda? How many of you have even heard of Jarritos soda?

Just jumping in to say, yes, I've heard of Jarritos soda, and although that would be my first impulse upon hearing the name, I wouldn't get confused by a restaurant.

And you're from Texas? Don't they have Jarritos down there? They sell it in every single store by me!! Including dominicks and jewel.

okay nevermind I get the point. But I think Jarritos soda is a lot more mainstream than you think. I am not particularly fond of latino/chicano cuisine of any type, and I don't frequent restaurants of such, but I do see that soda all over chicago and I do know what it is. So I think it's more well known than you think.
