I have no qualification to answer your question at all...

But I imagine there'd be a distinct line drawn between anti virals for diseases like HIV (which becomes life threatening as AIDS) vs Tamiflu (which *may* relieve flu symptoms). Herpes is unlikely to be covered either I imagine unless it is a complicated infection that is causing life threatening illness.

I know little about medicine, but I do know about jails. In jails and prisons, you have an 8th Amendment right to medical care. That medical care is going to be for what you need. If I recall properly, Valtrex prevents the spread of herpes. Since sexual activity is prohibited in jail, I wouldn't see that as a need.

Pretty much what I was thinking. I don't know about in the US, but here in Australia Tamiflu is only used when flus become life threatening (or for wusses who cadge it out of their docs), and I believe our policy on antivirals is based on medical need, not 'social' (sexual).
