par for the course. i honestly can't believe that people try to sue Big Tobacco because they were "misled" or whatever, and i would never try to do that myself. litigation like this is what clogs the wheels of justice and i see no greater good in helping it move along. at the same time, it is severely stupid of the JD to overrule the original decision. moves us backwards, not forwards.
