Assuming our countries' laws are similar, merging traffic gives way. It's always the responsibility of the driver changing lanes to give way to traffic in their target lane.
So, basically, he was wrong. I'm at the point in my driving though where I suspect everyone else of being an idiot and drive accordingly. In your situation I would probably have slowed down or changed lanes on the assumption that he would do something stupid like that. It's saved me from quite a few incidents that I know would have been very near misses or worse.
Changing lanes would have been nice, except for the fact that there was a guy in the next lane over, close enough behind me that changing wouldn't have been safe (note I reference that fine, alert gentleman above). And slowing down would have had Mr. Unconscious trying to merge right into where I was, which clearly was not to be desired. I can't make driving assumptions based on the idea that 'Well, he COULD merge into me, so I'll slow down [which would get me into an accident if this guy is a decent driver and so far I have no reason to believe he's not]."
It's my policy to store a vial of zombie blood in the glove box for just this sort of thing. If I were to be in an accident, and if I could reach for that zombie blood, why, even if I were dead I could come back as a zombie. Every car should have it.
In other news, I'm glad you're safe, and a pox upon people who change lanes without signaling.
