I never thought about it until just now, but my guess is it's partially due to the varying legal definitions of rape, depending on what country you're in (or even what jurisdiction you're in in a particular country - I know in the US, rape and sexual assault laws are different in each state). For example, marital rape wasn't considered legally rape in the US until some state decided it was in the 70s, and then all the other states followed suit; I think the UK had a marital rape exemption through the early 90s as well. So maybe it's just a way to state, "There are non-consensual sex acts in this fic," without having to wrangle with the varying legal and jurisdictional definitions of rape? I mean, I'm probably speaking out of my ass here, though.
