you know... i am a legal immigrant. it was hard to follow the rules but we did. i dislike the concept of illegal immigration, and i think it should be stopped. but... this is NOT the way. ugh. this is just... addressing the wrong issue, badly. sigh. idiots.
So, if you are a US citizen and hand your ID to a police person, and they toss them, then you are without ID and can be incarcerated. Or if they believe your ID is a fake, they can arrest you until it's determined it's a real ID. Then they can do it again (because, heck, you were suspected once, so now you're on their "hit list") and it's a felony.
What are citizens who are below 18 or don't have a driver's license supposed to do? This does affect both citizens and non, since if you are swimming you can be arrested for not carrying your ID with you. I never heard it was a requirement to obtain a picture ID to live in the USA. Or, if you report a pickpocketing incident as the victim, you can be arrested for not having your ID on you when you report the pickpocketing to the cops.
There is no way, even with the current court, that this is going to survive judicial review. Even with stop and identify laws, the court has been loathe to require more than verbal identification. Something that requires US citizens to carry and produce id? Very unlikely.
There is also additional privacy concerns, habeus corpus issues, racial discrimination, and even more other constitutional issues.
That it passed is depressing, but unless the court is insane, I can't imagine this not getting struck down aggressively.
