Hate the manager in Game. Yesterday we finally brought half life 2, and got the game of the year edition. Opened the box up to install it, and realised that a)it was the standard, not the GotY edition cd, b)the cd was scratched to buggery, and c) there was no activation code for it. So, reasonably enough, I took it back today to get the game I'd ( Read more... )

Ahem:

"puts on hat of 'I used to work retail'"

The manager of Game is quite frankly talking crap.

The two most important acts you need to be aware of are the Sale of Goods Act 1979 and the Sale and Supply of Goods Act 1994. These acts state that any item must:

Fit the description given, including on the label or packaging
Be of satisfactory quality: i.e. in good condition, safe to use, strong enough to last a reasonable length of time and have no faults.
Be fit for the purpose that they are sold for
Match any sample shown

If you bought it on your credit card you can write to the credit card company and ask them to refund it.

The alternative (can also be done for a CC purchase) is to

a: Call customer services and ask for the name and address that your complaint should be addressed to regarding the product sold and the subsequent service. For example, the store's area manager.

b: write to Game's Customer Services detailing the circumstances, the fact that the manager is breaking the law by not dealing with the complaint ( ... )

I can understand that the manager doesn't want to be scammed. However, unless they have a policy of opening the boxes, ensuring that the game matches the box and that the disc is in good condition he doesn't have a leg to stand on.

If they do have that policy and it wasn't adhered to this is also not your problem, but his training issue.
