Title: Season 5 x Episode 4
Summary: Money mess...but before the case can even be half finished, hateful brother is discovered.

Notes: I don't own any of these characters, just the situation.

"All rise. The honorable Judge Jeanine Pirro residing," he hesitated as the Judge walked into the room and spoke again once she was seated, "you may be seated." The officer turned and smiled to the judge, "hello, Judge."

"Hello, Keith." Judge Pirro smiled at him and shuffled her papers before turning her gaze to the men standing in her court room. "James Tarin is suing Matthew St. Claire-Tarin, his husband, for legal fees, mortgage payment and emotional distress and Matthew countersuing for emotional distress. Now, quite honestly I'm a little confused after reading your statements. You're married, you've been a couple for four years, you have one child and two on the way, you have witnesses say that you're happy together and have never had problems, this would be your first and it has brought you to my courtroom. It also says here that, Matthew, you're a recovering crack addict."

"Yes, your honor." Matt nodded in agreement. "The plaintiff, James, he helped me through it." He smiled at James and danced lightly from foot to foot. "I've been clean since 2008 with only two relapses."

"Good for you, good for you." She and the rest of the audience clapped for him, "but stand still." Judge Pirro raised a brow at him and Matt fell still with a soft 'thank you' and a sheepish smile. "It also says that, you James are a recovering alcohol."

"Yes, Your Honor." James placed his hands on the podium, "if I may speak?"

"Go ahead."

"Back in 2008, Matt decided to clean up his act for me. I have a large dislike for drugs. I knew I had a problem with drinking but I realized if he could stop crack, which is a harder addiction in my eyes, then I could stop being an alcoholic. It was a struggle but we made it."

"Together." Matt piped in.

"Good for you, both of you." She clapped, nodding. The rest of the court clapped, a few people whistled and Keith grinned. "Now, you're together, you're clean, James, what happened?"

"Well, Matt is in a band and he's always on the road …I don't really see him a lot and I thought we could work through it. He isn't around, he leaves me with our daughter, and I understand that because a tour bus is no place for her. But he doesn't help with the bills or mortgage, the little time he is home he leaves everything to me --"

"Where do you think the money you're using comes from?" Matt looked surprised, "I don't give you the money; I just put it straight into the bank because it's easier. If I knew you wanted it right in your hand I would have done that but since you tend to do bills at the oddest times I figured it would be easier and make more sense rather than calling you at three am and asking you if you want a check or you want me to wait until I'm back in California for cash."

"No, Matt, that's the money I make." The two were facing each other, "you haven't given me anything in the past year."

"I have too! For the last record and dvd combo, the three shirts, the five tour dates and the advance we got for the festivals we're going to be doing as well the album we're working on, there was the money from the singles, the advancement from the videos that we're still working on ideas for …James, I put almost over a hundred thousand in our shared."

James fell silent.

"Do you two even need a Judge?" Judge Pirro asked looking a little amused.

"Larry, you said there was barely anything there." James looked a little murderous and one of his witness's was looking a little nervous.

"Oh, this is going to be interesting …will you please stand up and state your name?" Judge Pirro looked interested at the turn around.

The witness stood up and brushed his hands over his pants, quickly smoothing them out as James and Matt stared at him, "my name is Larry Tarin and I'm James' older brother."

"And he has always hated Matty." Another voice broke in, "Your Honor, my name is George Ragan, I have known the defendant since high school, and we have always been close friends. I met the plaintiff in 2008 at the same party where they met each other. I'm the first to admit that we, the whole band, are a little protective over Matty, he's not a fighter and he tries to see the good in everyone which sometimes gets him into trouble…we weren't very open to James in the beginning and we're still a little wary of him at times but we, the band, realize he's here to stay. But we have never accepted his brother Larry and for a good reason. Larry hates Matty, he's constantly throwing his cocaine addiction in his face, talking down to him, giving shit."

"Language!" She banged her gavel, "Larry, is this true?"

"Well…"

"Yes or no!"

"Not really, let me explain!" Larry narrowed his eyes on Matt. "The first time I met my brother's husband, Matt was still an addict. He was strung out, he had two of his friends with him and they were high or drunk…talking about a gang bang or stealing or something, I don't really remember. James is my baby brother. I was worried for him -"

"Enough!" She banged her gavel again, "shame on you! Shame on you! Your brother and his husband got through their addictions together. They're married with children! And happy! You tried to ruin that! How dare you? Their relationship is none of your business unless they end up going down the wrong path and your brother says something to do you! Shame ON YOU! Stay out of their relationship! It isn't yours!" She banged her gavel twice, "no verdict, give your husband a kiss and I don't ever want to see you in my courtroom or any other courtroom against each other ever again. You two have an amazing relationship, keep it that way."

She closed the folder, stood up from her chair and swept out of the courtroom.
