The "worst" case of "legislation from the bench" was Brown vs. The Board of Education, which was absolutely the "right" thing to do. That understood, I find the "judicial activism" criticism something one should generally shy away from. It's just too politically convenient.
I won't debate with you whether or not abortion is an absolute right, mostly because I don't know for sure how I feel anyway. As a general rule though, I find it difficult to understand how anybody can be so sure it is or isn't a right.
I absolutely agree about Kennedy and Feinstein. Their behavior is equally as appauling as the Republicans on the comitte who, in their questioning, were really promoting the nominee they are supposed to be cross-examining. The politics of the whole thing have been disgusting and only Arlen Spectre has gone about it right. I think it was Biden who said we ought to do away with the hearings altogether, and I think I agree.
