Weeeellll, if POM is claiming their product prevents or treats disease, then they are marketing it as a drug, and they left themselves vulnerable for a governmental slapping. Boo hoo?

I don't think it's bad, just not a wonder drug. And yeah, they made some pretty specific claims and insinuated that it is a panacea of some sort, so... POM FAIL.
Most of the claims begin with "Clinical studies prove..." You can make "clinical studies" prove or disprove just about anything. I think the real suit should be against the U.S. Department of Education for allowing schools to get away with miseducating our population to believe everything we hear that comes from an authoritative (sounding) source.
Skimming over the press release, it appears that the FTC is setting itself up to disprove the claims... interesting.
