Hi there.

Can any of you lawyers out there provide me with some advice? It seems that somebody is trying to serve me papers(they tried to serve them to my parent's place, where I haven't lived for 13 years) from a 4 year-old accident, and I have no idea what I'm supposed to do next. When I got sued over an accident... the time limit (what's that called?) was 2 years. They served me (well, my insurance handled it) 2 weeks before the 2 years was up. You might want to check that out.

statute of limitations = 2 years then you are s.o.l.

In Minnesota it's 6 years.

"Personal Injury: Personal injury arising from negligent conduct, 6 years. Most personal injury resulting from intentional misconduct, 2 years."

I'm guessing the accident would fall under "negligent conduct", but I'm up to snuff with my law-speak.

I find it hard to believe that he's got any sort of a case. I've never seen a scratched door and a flat tire cause someone severe distress of any sort.

Statute of limitations? Yeah, that.

I called my insurance company immediately last night, but the lady that is handling it wasn't working at midnight. Crazy lady.

I'm guessing the statute of limitations for MN might be 4 years, because it will be exactly 4 years on August 30th. It makes sense as to why he'd be doing this now.

any insurance company worth a lick should still handle that shit. i would talk to them first.

I talked to them today and that's what I was told. The reason I'm being served is because Geico wouldn't pay them the $40,000 they wanted. Ha!
