I think it should be against the law to use a cell phone while driving if you're just holding it up to your ear (therefore driving with one hand) but not if you have a headset (therefore both hands are free to drive).

I have heard that and definitely see why that would be true. I guess I'm just thinking more in Pittsburgh terms, where all the roads are windy and up hills... It's a lot easier to drive with two hands than with one, so I feel like I drive a lot better when I'm using a headset versus just holding the phone.
i think it should be illegal unless you are using a handsfree method such as speakerphone or a headset. i realize they also have done studies showing that the headset is nearly as bad as holding the phone (because it's a huge distraction), but if you base it on that then they should also have to make eating, smoking, changing cds/stations, talking to passengers, and so on and so forth illegal as they are all just as distracting.
I believe in headsets all the way if you are going to use your cell while in the car. To ban them totally is going to be a bit ignorant (IMHO) because then you should have to ban eating, talking to passengers, singing to the radio, changing radio or CD stations, and basically anything else you do in the car while going down the road
