Imagine if President George W. Bush had his policies ruled unconstitutional in the courts and he continued with them anyway. Or if he suddenly decided that he just didn't like a certain law and told his AG to stop defending it. The Left (and mainstream media) would be awash with cries for impeachment. It'd be a never-ending news cycle scandal

i think the point with the defense of marriage issue is that it is not defensible as being constitutional. it is a violation of equal protection and due process laws.

I personally happen to agree with that, and it's been the same argument against a lot of the State's attempts to pass similar amendments to their own constitution. I don't know enough about any cases brought against the federal DOMA, but it doesn't seem to have been sufficient to have it overturned thus far and it was passed way back in 1996.

My broader rant was about the President's dramatic over-stepping of the boundaries of his office. He doesn't have the power to do that, and he's just completely side-stepped the entire judicial and legislative branches of government. For a lawyer, he seems awfully comfortable ignoring the law.
