if it is transparent to the user, then why bother coding it when you can just SAY you coded it and instead spend the time playing NCAA Football '08

because when the fbi comes to your door, it's easier to microwave one hard drive and turn the other one over to them than to store it all on the one that's toast

or whomever tries to subpoena you
just because it's transparent to the user while he or she is using it doesn't mean they don't know about it
that's why you mention it in your privacy policy
