Now that I think about it, you're right. But how about this: You walk into a store and purchase a food item that requires the use of a spoon. Let's say a small container of ice cream. Instead of leaving the store, you walk over to the aisle containing the plastic cutlery. You open up a package of plastic spoons, use one to eat your ice cream, then wipe it clean and place it back in the package. You did not pay for the spoon, but you made no attempt to conceal it or leave the premeises with it. Unlike the soda, you have not consumed any part of the spoon.
