unless otherwise specified in your lease, the landlord has 30 days in which to return your deposit, unless some sort of significant damage has been done to the home which will require full compensation.
if you mail her a certified letter informing her of this law, she still has an additional 14 days in which to respond, and if after that period she does not, you do have to take her to small claims court. there won't be an additional amount on top of what you should be getting back, except for your filing fees if you request them.
basically you should find out why you haven't gotten it back yet, and if there's no good answer, sue.
14 days, that's good to know, thanks. I'm going to to send her the letter before I leave, and if I haven't gotten anything back by the time I'm home, well, then. Yeah.
We left the house in good condition on January 23rd. I've tried calling her and she's actually lied to me about some things, and no deposit too. So yeah, I'mma gonna sue, I think.
I was slightly confused about if I took her to court and an unreasonable amount of time had passed the deposit could be doubled or even tripled, in some states, that seems to be the case.
So it looks like if she has acted in "bad faith" i.e., she lied to me about the return of the deposit, (long story) I can get double the money only in small claims court as a penalty fee to her. Seeing as how it has been over two months, I think the law would be on my side.
