So since I was still having symptoms of some kind of cold I decided to call out and get a diagnosis from a doc. MY first worry was that I had a very mild case of swine flu and had been spreading it around all week, but I was very happy to discover that I just had a sinus infection. Another lesson you need to learn- Get a "police" report from campus security. You live in a no fault insurance state and that means that you aren't paying. Bike was parked illegally and take photos of bikes parked that way today. Yes you hit him but if he was acting legally you could not have hit him- get report and call your insurance/agent and explain what took place.
You are not paying.

So what you're saying is since we live in a no fault state that his insurance would pay for his damage and that since he is illegally parked my insurance would not penalize me?

I believe so. What does the report actually say? Does it say where he was parked and all? If not go to the security spervisor and explain that it is now costing you money cuz he haas decided he wants an axel- oh, btw, make him report it to HIS insurance - don't hand him any money.

You should always take photos...be it a cellphone or digicam or even a cheap disposable one you keep in the trunk/glove compartment/under a seat.

also...quit buying those prada shoes and GQ shades...no wonder you haz no extra money.

I know little of NYS car insurance and accident things but, like the other person said, it shouldn't be your fault you hit him when he was doing something illegal.

You watch people's court, right? (i believe i read that here sometime)...this sounds like a case in which some guy steals another guy's drugs and now the victim is suing the thief for loss of wages.

Just talking to your insurance person shouldn't be a problem...nor getting a petition list from car drivers in that parking lot so that the parking office enforces laws against bikes parking everywhere...

and what kind of cop doesn't give a ticket for something illegal? Is it just that I'm biased since in NYC you get 6-10 months for jaywalking and a two month probation for murder?

I think the reason the cop didn't give the guy a ticket and didn't report the accident was to give us both a break. From what I've seen watching the People's Court is that when you are driving you are always responsible for accounting for everything around you. It wasn't as if the bike was hidden or hard to see. As I said in the post I could have swung out to the right but I didn't think of doing that nor was I thinking about the bike since I was looking at the van parked next to me since I couldn't turn my wheel until I cleared it. I think if it had been clearly the other guy's fault as you guys think the cop would have given the guy a ticket and gone the whole way ( ... )
