I've seen stories of things like this, they are allowed to marry the person of their opposite sex in their current form. As for Herms? I dun really know, but I think they have to register as one or the other, and therefore are allowed to marry the opposite as what they "claim" themselves to be.
Don't worry, my mind ponders things like this too.
