It really depends on whether you released the image as creative commons or not. Check your release information. If you didn't, then you can send them a cease and desist and ask them to stop using your imagery, especially if they are using it to make a profit
it is an old shot, before we had the option of setting CC etc. so there is no license, but I dont mind,, it just would have been nice to get a message requesting to use it :)
It's a big problem online. I've also found people often use a pic and THEN ask permission, instead of the other way 'round. DA has an option now where you can choose the level of licensing, as well as attach a custom permissions document to each upload... if you want to get that technical. Still, even if CC licensing is marked as permitted, it's polite to ask first IMHO. I'll usually say yes, unless it's a personal character/commission/etc.
