IMO, the term plagiarism was likely used incorrectly and picked up repeatedly by various news outlets. I can't see this being anything other than an infringement suit. I agree Plagiarism is an academic term. There are some interesting similarities to the claims between this and the JKR suit. Both claimed to have done everything to avoid bringing the matter to court.
This might have a bigger hurdle to cross in proving copying than in the Lexicon case. It is possible under the law that two could come up with remarkably similar works without being influenced by the other. Satriani would have to prove that Cold Play knew of the piece and intentionally copied it. I don't know enough to even comment on that. I think the 2nd video is less convincing than the first. This might be an intriguing case to follow though.
