The problem with insurers is that they operate on an automated basis. So, if you are the car behind, you will be the one whose policy will be claimed upon, whatever the actual facts of the specific case. How it works is, if you want to take up the matter, you will have to go to the court yourself, hire a lawyer etc. etc. to turn it around. I think they operate in this way since the volume of cases is too much for them to handle on a case-by-case basis, so they just automatically decide based on one basic fact - who was the car behind? In Malaysia, this is especially annoying when it comes to motorcyclists, since no matter what the hell the biker did, the one driving a car is liable. If you want to prove otherwise, you will have to go to court.
