In my opinion, for what it's worth, a fanfiction can't be derivative. It's hard to write fanfiction (and I may be saying that only because I CAN'T write something else than ''original fiction'' xD) and yes, it is your work. But it's implied: fanfiction; playing with someone else's idea. As long as you know that, it's not, I think, derivative art.
But hey that's only my little opinion! And now I'll stop bothering you with my rambling but just adding: Please, do make a weekly blog of this! And thanks for making me use my brain today. It doesn't happen that much on LJ. :)

That's exactly what I'm saying, is fanfiction simultaneously has to be and yet isn't derivative. The word can't really apply because of that. It's more "studying" or "basing on", but deriving is claiming it's yours when it's clearly copying someone else's.
