I agree with you about the Bill Clinton thing. I winced when he made that press release, given that he signed DOMA and even bragged about it while campaigning.

Not sure I see how the US Federal Supreme Court is "selling out." Scalia and Co. see themselves on a moral quest to fix a degenerate America. The constitution is either a dead or a living document, whichever is more convenient for them at the moment.

Here's my thinking on the sellout thing: If standing were to have been granted to Proposition 8's ersatz defenders, then where would be the boundaries of that precedent? Suppose nobody in an individuals-versus-government case involving (say) some toxic chemical is willing to take up the quarrel against restrictions on it? Seems to me under a Prop-8 standing precedent, Monsanto or Ethyl or the American Chemical Council could magic themselves into the lawsuit and spend far more money than the individuals or the government on litigation alone, not to mention perks and gifts to Supreme Court Justices, thus ensuring a high(er) likelihood of the case coming out their way.

I remember, back when the Soviet Union was still around, my dad saying something like, the one good thing about communism is that it makes forces the capitalist countries to be better to it's citizens so that they don't go communist.

So by that logic, I think now that communism isn't really around in any real way, there's no incentive to make things better. We're not going to want to go communist no matter how bad they make things for us.
