Well yeah....such a thing could have been easily avoided. I would not forget to mention something if I wanted a photographer at a nudist ceremony and nobody should be forced into a contract where they don't know whats going on.
Freedom of religion and the practice thereof is a very important pillar of American society. I'm wholeheartedly with the photographers on this one. They can't be forced to take a job they don't want just because they're in business to shoot pictures.
It was a civil rights commission who targeted them though, which is interesting, but causes some concern. Although I don't personally feel this way, it could become a legally defensible opinion that they cannot "discriminate" against gays by not taking their photos in the same way that the photographers cannot "discriminate" against black people by not taking photos of them due only to their race.
I sure hope that government's overreaching of their authority gets slapped down as it should on this one. Keep us posted, will you?
