It actually was a really hard decision, but I think BW did a decent job of arguing that the death penalty is administered by a jury of your peers - i.e., somewhat democratically. I also think you would have done well to argue the constitutionality of capital punishment. And for the record, I'm anti-death penalty, so it really was based on the arguments.
