no... for inciting or promoting hate in a public place... that's what the law you posted specifies... and they aren't just being held... they have been convicted of either:

1) Speaking about anything that is likely to cause a riot
or
2) Singling out individuals or groups because they are different and promoting hate against them.
which I agree that they should be in jail... but I agree with you about the teacher, as long as he is not one of the people being arrested for the afformentioned.

i was reffering to another case i was made familiar with: Earnst Zundel.

He IS in jail for publishing a white supremacist newsletter that denies the holocaust.

its a huge bullshit thing. and basically he is thinking in a non-politically correct way, and the publishing of the material is an extension of his thought, just as his speech would be.

he is in jail. and its an invasion of personal freedom, no matter how much of a cunt he is.. he should NOT be in jail for publishing anti-jew stuff. I am bisexual.. the bible is printed which is anti-gay.. why arent those publishers punished?

promoting hate? what about all those bin laden jokes that get sent everywhere.. i get like 2-3 a week from friends. is that promoting hate?

i think it is. should people be arrested for that?
no.

even the fundy xians would be put in jail in canada for their views with the laws withstanding.

I think you are right on the freedom of speech view even if it a racist view it should be allowed to be published. People are drawn to that which they are not allowed to read or speak, if Zundel is locked up for what he says the government lends credence to what he says in some people's eyes... that is more dangerous as his views are anti-jewish.
You let him speak and people will see him for the fool he is, shut him up and people will wonder.
I grew up being raised to view a person by their personality,skin colour or religion had no bearing on my views.How you act does.
Oh and the spell-check says I spelled colour wrong :) must be American.

It seems that is an occuance in other parts of the country. In Michigan, a few years ago, a lady and her daughter were leaving a restaurant. They were approached by a hispanic couple, that spoke no English, asking questions. As the lady and her daughter didn't speak Spanish, the Hispanic couple grew rather upset.

The mother said to the daughter "I have no problem with foreigners coming to and moving to the US, but they might want to learn English in order to communicate better."

Unfortunately, there was an off duty Deputy Sheriff that witnessed the situation and overheard the mother's comments to the daughter. He followed them to their car and wrote down their tag number from their car. While driving home, the mother and daughter were pulled over by another Deputy Sheriff and arrested. The charge? Implied Racism. I do not know how the situation fared, etc as the article was written prior to the court case, but I was horrified that our police forces have that much authority.

Damn. I sorry. I am unable to link that as when I heard the story, it was actually on the news and I didn't read the story as it was just news line. I will try to find the story though.
