He isn't above the law, in this case at least. He's working within the law. The President can pardon/commute whatever he wants, for whatever the reason.

Also, it was FAR less than 51% of the population that voted for him.

I can't stand Bush, but this is exactly the call I would have made in his place. Actually, no, I would have given a full pardon and given the finger to the special prosecutor who wasted millions on going after a man he likely knew was innocent of the crime he was accused of.
