Whatever Happened to the Personal Guarantee?

So I took a vacation day today to purchase Fallout 3 and had intended to play it all day long. I had found a 7-Eleven where the owner sold pre-orders and would let you pick them up at midnight, the day it was released. I was actually excited about this. So I get there and BAM! I find out he didn't get it and I was out of luck. He refunded my money
