I knew that when I woke up this morning that today was going to be a bad day, or maybe it was when I fell asleep last night. Yesterday, I lost five bucks at a fantasy shop and today, when I was leaving the Quick Trip on the right hand side of Goshen Road, I got slammed into by an older lady driving a black Volkswagon ( Read more... )

Fault does NOT fall to the youngest driver. Depending upon the situation, fault can be assigned to the person hit, rather then the person hitting.

I'm living proof; I'm 34 and the guy who hit me three weeks ago was... about a hundred and fifty. (actually, I'd put him in his seventies.)
Fault was, indeed, assigned to him.

But this is not always the case. Intersection? Parking lot?

If I come across any used car parts/junk yard lots, I'll let you know.

In the mean time, get thee to a chiropractor. Pronto. Do NOT wait until the damage to your neck is expensive to repair.

My sister got hit about five times and none of those times was her fault and she got the ticket each time. One of the times she got hit was by her teacher, who was talking on her cell phone. So... I dunno. But 150? Really? People that old shouldn't be driving. ^^

They assume it's the younger driver's fault. Contest the ticket and dispute the incident with your insurance company.

You don't have to win both, incidentally, even if you still have the ticket your insurance company can decide that the other party was at fault and fight their insurance company for you.

I heard the whole story of the accident, and technically, by the law at least, it was sam's fault. However, if the other party does not show up to court then you win the suit.
The other woman had the right of way, thus even though sam was waved to go by another person, it is still her fault for failing to yield to the second car.

But I didn't see the car. Anyway, I'm not gonna contest it in court. I don't care. I'm just gonna pay the ticket, fix the car and move on with my life.

This is true. Some cops simply assign blame to the younger party, I suppose. It is not the standard, and it is NOT the law.

If you're going to take this route, though, I would contact an attorney.
