It isn't a penalty. If you choose to not participate by signing up for health insurance, you are taxed. One of the important elements of the bill is that if you're poor, you'll get assistance buying the health insurance or paying the tax, whichever you choose.

One of the common sentiments I hear is "I shouldn't have to pay for Joe Bob's insurance if he can't afford it himself!"

Problem is, by that logic, you shouldn't have to pay for our fire departments, our police, or things like the FDA that do at least some work making sure that the food industry doesn't feed us coal and call it a brownie.
