Yep. That's the course of action I would recommend, too.
I'm not sure if you're seeking to burn your bridges here. If you are not, then a simple email informing them that 1) you have already published elsewhere, so rights of first publication are not available, 2) you never agreed to give them any sort of exclusive right, and 3) if they wish to negotiate for such rights, they know how to contact you. If you do not want anything more to do with these people, then you can tell them they do not have permission to publish your article and you are withdrawing your piece from consideration, and cite their policy as a reason for doing so.
I to say they're full of beans. Seeing as how it was never mentioned I the first place. I'd tell them better luck next ti e, it's my copy write and y'all better bugger off. Or something nicer.
