Not sure I'd condemn the professor. I can imagine being that absentminded, horrible as it is. People do that to their dogs too, forget that infants and other small creatures are more vulnerable to things like that. When you've got 10,000 things (figuratively speaking), it's easier to forget to appreciate the little ones.
On the other hand, the unequal punishments for their mistakes is appalling. Losing a baby that absentmindedly should be punishment enough. What they did to the Hispanic guy was just plain wrong.
There are basically two reasons for locking somebody up: 1 - to reform/rehabilitate them 2 - to protect others from them
as he said, he'd more than learned his lesson because his daughter died. so no need to rehabilitate. and do you think he's going to do it again? The professor is more likely to make the same mistake twice since he forgot (he knows this since he now uses a strap to make sure he can't leave), but the hispanic guy made a conscious decision which he now knows was wrong. So as he himself noted, his punishment serves no purpose.
Also, I really don't think prisons ever do a really wonderful job of "reforming" or "rehabilitating" people. Based on what I've read, they tend to do exactly the opposite. Applying external punishment in either case is completely asinine. I can't imagine what the conversation with his wife must've been like.
And what an awful way to get a Darwin Award...*wince*
