im am so sorry to hear about you going through such crap. i wonder if there is a branch of landlord-tenant, or something similar, in you area? im sure they would have some information on what actions you can take.

good luck.

i've made several phone calls today and have found renters rights to be top notch here so far.

we just uncovered something that i won't discuss online as one roommate is privy to these posts.

ughhh.
i really dont have any valuable information or advice, but are you going to try to obtain a copy of the lease from the head tenant? get those records of prompt rent payments, etc etc. just to show that you are indeed a reliable tenant.

i didnt know you could be evicted over personal issues, unless it's regarding to violence or proof of distress.

people are such a-holes.

whoa bryan. the paper you signed waiving your right to a legal and reasonable eviction is NOT LEGAL. I as a landlord know that you legally cannot make anyone sign over their rights to a fair eviction to be held in court. I would look up the California Landlord Tenant Act and read it. Sub tenant or not, you have a right to the lease, and if you are living there then you have just as many rights as any other tenant that lives there, whether your name is on the lease or not. If we have a house where it is a girl on the lease and her boyfriend has been living there for 6 months and they break up and she moves out, we STILL have to go to court to evict him because he was legally a resident there.

Trust me, Landlord/Tenant laws are built STRONGLY in the favor of the tenants and they have NO right to make you waive your ability to have a legal eviction process. If you want to deal with it you can tell them that they will have to go through the formal process.

If you need more help e-mail me, ok?
