Stane was CEO in trust for Tony - Tony becomes CEO on his 21st birthday but - being Tony - kept Stane on as an executive. Stane as CEO also took the company public - so the board of directors would likely have kept him on.
As Tony knows business - even if he wasn't particularly interested in it, Stane barely loss any power over the company.
So when Gen Ross gets weapons from Stark Industries - per the timeline, Tony is CEO but odds are it's mostly Stane that deals with it.
Stane's initial plan was to have Tony killed by the Red Hand - so it's possible that Tony had started questioning things just prior to Iron Man.
