Despite the fact that Piratebay.org hadn't actually broken any laws (sweedish or international), Sweedish courts found that Priatebay.org and it's founders were guilty of aiding copyright infringement (although they never hosted files) and were given a 1 year prison sentence and a $3.5M (USD) fine. google doesn't just link to the torrents, in many cases they link directly to the pirated content directly. if anything, they are even more guilty than the pirate bay.

but that's the reality modern technology places us in. content providers can only litigate their way around dealing with reality for so long.

I haven't really been following the case, but I'm guessing the fact that it's called "piratebay.org" hurt them. Google can easily claim that their site isn't meant to facilitate copyright infringement. Calling it piratebay makes it rather difficult to argue that the purpose of the site isn't pirating material.

from a semantics standpoint, yes. from a purely legal standpoint, it shouldn't matter.

was this a jury trial or a judge ruling? i'm honestly not sure.
