Finn walks in on Kurt and Karofsky having completely consensual sex, but he interprets it as Karofsky forcing himself on Kurt. Karofsky vehemently denies it, and looks to Kurt to defend him. Kurt is clearly incredibly embarrassed, and the shame is visible on his face. He also isn't jumping to Karofsky's defence.

At worst, he isn't flat out denying the rape accusation. At best, he's claiming that it's only sex. Which is a huge problem, because David certainly didn't think of what they had as either of those.
