Man, my boss and I were just talking about this case (she's a comic artist), and man do we need the CBLDF more than ever. I never understood this taboo about cartoons and artistic representations about illegal acts---how can we define obscene when that is such a subjective term? And, yes, japan is a culture in love with a very youthful ideal. We've known this for decades; it's hardly a surprise. The fact that lolicon exists doesn't mean that actual, living children are being victimized. I have profound respect for anyone who has a fetish that would be illegal to carry out in real life and manages to divert that sexual energy into harmless channels.
I'm pretty sure this is First Amendment territory. Regardless of the subject, how do we define whether the material has “serious literary, artistic, political, or scientific value?” In essence, what we're doing is outlawing ideas. Not actions, not speech -- ideas.
What a stupid law. If I was on the Supreme Court, I would overturn it as unconstitutional, arguing that enforcing the law would actually defeat its intent -- it would actually increase the potential amount of child abuse, because it denies (as xevv pointed out) those who possess unusual sexual appetites a channel for exercising them that is not harmful to society.
