I definitely think it should be the 10 year old who gets it. The man (teacher) threw it out. It was in the garbage. Clearly it shouldn't be his. As for the 12 year old, "rolling" the rim doesnt constitute ownership. The 10 year old asked the 12 year old to open it for her, I'm assuming. I don't know the exact words or what she said but Im pretty sure she didnt say "hey, i found this cup... how about you have it". Im sure it was just rolling help, and none of this would have happened had it not been for the 10 year old, therefore, its hers. Arguably, it wouldn't have happened without hte teacher, but he lost ownership.
