That's so awful. This is why people still don't trust hospitals. They say most cases like this go right under the radar.
My mom lost her battle with the hospital over my Pap's death bc my Aunt wouldn't follow through with the paperwork. A nurse gave him a sedative the night before he was to have a defibrillator replaced bc he was 'acting out' (he was confused and he had been sick for 3 weeks). The sedative slowed his heart and then it stopped and he died. But the thing is your not suppposed to give a patient shit the night before sugery and no doctor approved giving him the drug. So the nurse got a slap on the wrist and my Aunt bought the story that the drug didn't kill him and that was the end of that courtcase. I hope your family fares better. Most poeple involed too easily dismissed the case bc 'he was old and weak anyway'. Maybe since your uncle was young and healthy to start people will care more.
Why the fuck can't a brother or sister file such a lawsuit in Texas?
I have no idea why a brother or sister can't file a wrongful death lawsuit in Texas. I think that is an extremely stupid law. My stepmom's dad is 84, and god forbid if he were dead this hospital would automatically get away with it since there would be no one to file the suit
