well the previous owners are in violation of section 11C of the contract, so are at fault and I CAN sue them ... but I need to find them first. I doubt the inspectors will do anything because their warranty ran out already.

Aktually, with all the crap these people had (plasma tv, each kid had 2 computers and a 360, etc) I think they just put paying their mortgage on the bottom of their list of things to spend money on. It may be that the encored a ton of debt on the house just so that they could shortsale it and pocket the extra cash in the form of THINGS. Cause the bank definitely got back about $40-60,000 less than they lent out ...

The place to start might be to get a quick and dirty legal opinion at FindLaw.com. It costs like $10 or something. They should be able to tell you, at the very least, whether you have grounds for a case. I have no idea about issues such as these but I will ask a few people I know in the real estate business.
