Hospital first, then jail, she will see the Judge on Tuesday for arraignment.
Playing a 2.1 when driving is a Felony.
She will lose her license for 6 months, be under house arrest for 2 of those 6 months (with an ankle bracelet), and then she will have to get special license plates and insurance for people with DWI's after that.
It is our intent to make her life such hell that she leaves the neighborhood before the 6 months is up though.
And if she does (by some miracle) find a way to afford the insurance so she can drive in 6 months and she hasn't left the neighborhood I expect a lot of spontaneous breakdowns such as bad tires and such to happen to her vehicle magically as if by elves. Not that I would do such a thing (or admit that I would on the internet) just that I get the feeling from the people in the area who fear for their children's lives.
I know the process because a bartender friend of mine laid it all out for me. He said this is the base line.
And I know from when I bought my motorcycle from a drunk driver I had to swear under oath that I didn't know the guy I bought it from and that I wasn't just putting plates on it so he could drive it without whiskey-plates.
So, she can't get around it by having family help her.
Last night as I was coming home from the Twins game, there was a drunk guy on a bicycle, weaving across a crosswalk (we all waited for him, even though he was crossing against the light) and I watched the first car pass him, and I watched the guy on the bike swerve into the side of the car (which stopped) and flip up and over the trunk... and stand up and cuss out the driver... and then try to bike away...

I know someone thru Xanga that lost her brother to a lady that had 20+ convictions of DWI/DUI, driving with her license permanently revoked and in an un-insured vehicle. That lady blew DWI levels on the night she killed the friends brother.
People that do this should wear permanent bracelets/anklets, every vehicle should have an automatic shut-off for them and they should have to do a breathalizer to be out of the house.
Someone like this is barely above a murderer, rapist or pedophile in my books.
Someone drunk does the things they do while drunk as an act of premeditated malice. Alcohol is not an extenuating circumstance but a proof of premeditation.
