Father Christmas is an impartial observer, and I am sure he will take intent into account.

Had I had a choice in the matter, however, I wouldn't have put in he bit about food. I think it goes without saying.

I think he'd have to be sentimental to a certain degree, considering his line of work.

Perhaps whoever was in charge of what did and did not make the list did not consider it a grievous offense.
